This website is operated by Elemental Energy Co Pty Ltd (ABN 76 636 078 101), trading as Thirsty Threads.

Throughout these Terms, “Thirsty Threads”, “we”, “us” and “our” refer to Elemental Energy Co Pty Ltd.

These Terms apply when you visit www.thirstythreads.com.au, purchase a product or otherwise use our website and services.

By using the website or placing an order, you agree to these Terms and our applicable policies. If you do not agree, you should not use the website.

Eligibility

You must be legally capable of entering into a contract to place an order.

If you are under the age of legal capacity in your location, a parent or legal guardian must place the order or authorise your use of the website.

You must provide accurate, current and complete information when placing an order or creating an account.

Products and Product Information

We make reasonable efforts to display our products, colours, descriptions, sizes, measurements and images accurately.

Colours may appear differently depending on your screen, and minor variations can occur between production batches. Measurements and fit guidance are approximate and are provided to help you choose a size.

Thirsty Threads Hybrid Boardshorts and their built-in liners are designed to help reduce chafing and improve comfort. Individual fit and experience can vary. Product descriptions do not constitute a medical guarantee that chafing can never occur.

Nothing in this section excludes your rights if a product is faulty, materially different from its description or otherwise fails to meet a consumer guarantee.

Availability

All products are subject to availability.

Adding an item to your cart does not reserve it. In the unlikely event that an item becomes unavailable after you order, we’ll contact you and provide an appropriate alternative or refund.

We may limit quantities where reasonably necessary to prevent fraud, reseller activity, pricing errors or misuse of a promotion.

Orders and Acceptance

When you place an order, you are making an offer to purchase the selected products under these Terms.

An order confirmation acknowledges that we have received your order. We may decline or cancel an order before dispatch if:

  • A product is unavailable

  • Payment cannot be authorised

  • There is an obvious pricing or product-information error

  • We reasonably suspect fraud or unauthorised activity

  • We cannot deliver to the address or destination provided

If we cancel an order after payment has been taken, we’ll refund the affected amount to the original payment method.

A purchase contract is accepted when we confirm dispatch or otherwise supply the product.

Prices, Taxes and Currency

Prices are displayed in the currency selected for your market or shown at checkout.

For Australian customers, displayed prices include GST where applicable. Delivery charges are shown separately before payment unless free shipping applies.

International orders may be subject to exchange-rate differences, import taxes, customs duties or other charges. Where these amounts are not collected at checkout, they are the customer’s responsibility.

We may change prices and offers at any time, but a price change will not affect an order already accepted, except where there is an obvious error that we bring to your attention before dispatch.

Payment

Payment must be made using one of the payment methods offered at checkout.

By submitting payment details, you confirm that you are authorised to use the selected payment method.

Payments are processed by Shopify and the applicable payment provider. We do not generally receive or store your complete card details.

Shipping and Delivery

Shipping methods, charges and delivery information are set out in our Shipping Policy and confirmed at checkout.

Customers are responsible for providing an accurate and complete delivery address.

Delivery dates are estimates unless we expressly agree otherwise. Carrier, customs, weather and other delays can occur outside our reasonable control.

Nothing in this section limits any rights or remedies available under applicable consumer law.

Returns, Exchanges and Refunds

Change-of-mind returns, exchanges, Final Sale exclusions and refund processing are governed by our Return and Refund Policy.

Our voluntary return conditions do not limit any rights you have for faulty, damaged, incorrectly supplied or misdescribed products.

Australian Consumer Law

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.

You may be entitled to a repair, replacement, refund or other remedy if a product fails to meet a consumer guarantee. The appropriate remedy can depend on whether the failure is major or minor.

Nothing in these Terms excludes, restricts or modifies a consumer guarantee, right or remedy that cannot lawfully be excluded.

Promotions and Discount Codes

Promotions and discount codes may be subject to separate conditions, including eligibility, dates, product exclusions and usage limits.

Unless otherwise stated:

  • Discount codes cannot be exchanged for cash

  • Only one discount code may be used per order

  • Promotions cannot be applied retrospectively to completed orders

  • Promotions are available while stock lasts

We may correct or withdraw a promotion where there is an obvious error, technical problem, fraud or misuse. This does not affect orders already accepted unless required to correct an obvious error or unlawful transaction.

Gift Cards

Gift cards are subject to any conditions displayed when purchased or issued.

Gift cards cannot be returned or redeemed for cash for change of mind, except where required by law.

Website Use

You must not use our website:

  • For unlawful, fraudulent or misleading activity

  • To infringe another person’s intellectual property or privacy rights

  • To upload malicious code or interfere with website security

  • To scrape, copy or commercially exploit website content without permission

  • To impersonate another person or submit false information

  • To harass, abuse or harm another person

  • To attempt unauthorised access to our systems or accounts

We may restrict access where reasonably necessary to protect customers, our business or our systems.

Intellectual Property

The website and its content—including the Thirsty Threads name, branding, logos, product designs, photographs, graphics, text and videos—are owned by or licensed to us and are protected by intellectual-property laws.

You may view and use the website for personal, non-commercial shopping purposes.

You must not reproduce, modify, distribute, sell or commercially use our content without written permission, except as permitted by law.

Reviews and Other Customer Content

If you submit a review, photograph, comment or other content, you confirm that:

  • You have the right to provide it

  • It reflects your genuine experience where relevant

  • It does not infringe another person’s rights

  • It is not unlawful, defamatory, deceptive, abusive or malicious

You grant us a non-exclusive, worldwide, royalty-free licence to display, reproduce and use submitted content in connection with Thirsty Threads, our website and marketing, subject to applicable law.

We may moderate or remove content that breaches these Terms, but we are not required to publish every submission.

Third-Party Services and Links

Our website may contain links to, or integrate with, third-party services such as payment providers, social platforms, delivery carriers and other applications.

Third-party services operate under their own terms and privacy practices. We are not responsible for third-party websites or services outside our reasonable control.

A link does not necessarily mean that we endorse all content or services offered by that third party.

Privacy

Our collection and handling of personal information are described in our Privacy Policy.

By using the website, you acknowledge that information may be processed by Shopify and other providers needed to operate the store, process payments and fulfil orders.

Errors and Website Availability

We may correct typographical errors, inaccuracies or omissions relating to products, prices, promotions, availability or website content.

We do not guarantee that the website will always be uninterrupted or error-free. We may temporarily suspend access for maintenance, security or technical reasons.

If an error affects an order you have placed, we’ll contact you and provide an appropriate option, which may include confirming the corrected details or receiving a refund.

Liability

Nothing in these Terms excludes or limits liability, consumer guarantees or other rights that cannot lawfully be excluded or limited.

To the extent permitted by law, we are not responsible for indirect or consequential losses that were not reasonably foreseeable when the relevant product or service was supplied.

Where the law permits a limitation of liability, our liability will be limited to the extent that is fair and reasonable in the circumstances.

Suspension or Termination

We may suspend or terminate access to the website if you materially breach these Terms, engage in unlawful activity or create a genuine security or fraud risk.

Termination does not affect rights and obligations that arose before termination, including payment obligations, accepted orders and applicable consumer rights.

Severability

If any part of these Terms is found to be unlawful or unenforceable, that part will be read down or removed to the minimum extent necessary. The remainder of the Terms will continue to apply.

No Waiver

If we do not immediately enforce a provision of these Terms, that does not mean we waive our right to enforce it later.

We may update these Terms when our services, business practices or legal obligations change.

The Terms applying to an order are those in effect when the order is placed, unless a change is required by law or agreed with you.

The latest version will be published on our website with its updated date.

Governing Law

These Terms are governed by the laws of Queensland, Australia.

You and Thirsty Threads submit to the non-exclusive jurisdiction of the courts of Queensland and applicable Australian federal courts.

If mandatory consumer protections in your country or region apply, nothing in this section removes those protections.
